1. Acceptance of Terms

By accessing or using Queyn ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform.

2. Service Description

Queyn is a synthetic foreign exchange (FX) simulation platform for educational and training purposes. The Platform provides:

• Real-time synthetic market data generation
• Parametric control over market conditions (volatility, trend, liquidity stress)
• Strategy testing and position management simulation
• Bot API integration for automated trading simulation via WebSocket
• Technical indicator overlays (EMA, RSI, MACD, Bollinger Bands)
• Drawing tools for chart analysis
• Data export capabilities (CSV, JSON) for analysis and training
• Pre-configured template sessions (NY/London overlap)

3. No Financial Advice Disclaimer

Queyn does NOT provide financial, investment, or trading advice. The Platform is designed exclusively for:

• Learning trading strategies in controlled environments
• Understanding market dynamics through synthetic scenarios
• Testing algorithmic approaches with generated data
• Educational research and training purposes
• Data generation for machine learning and strategy development

IMPORTANT: Simulation results do NOT predict real market performance. Synthetic data performance is NOT indicative of future real results. Users should consult qualified financial advisors before any real trading activities.

4. User Accounts

4.1 Registration Requirements

• You must provide accurate, complete registration information
• You must be at least 18 years old to use the Platform
• One account per user unless otherwise authorized
• You are responsible for maintaining account security

4.2 Account Security

• Keep your password confidential
• Notify us immediately of any unauthorized access
• You are responsible for all activities under your account
• We reserve the right to suspend accounts for suspicious activity

4.3 Authentication Methods

We use secure httpOnly cookies for authentication. Google OAuth integration is available for convenience. By using the Platform, you consent to our authentication mechanisms.

5. User Conduct

5.1 Prohibited Activities

You agree NOT to:

• Use the Platform for any illegal purposes
• Attempt to hack, disrupt, or compromise Platform security
• Share, sell, or transfer your account credentials
• Use automated systems to access the Platform (except through our official Bot API)
• Scrape, copy, or reverse-engineer Platform code
• Interfere with other users' experience
• Violate any applicable laws or regulations
• Share API keys publicly or use them for unauthorized purposes

5.2 Bot API Usage

• Bot API access is subject to rate limits based on your subscription tier
• Free tier: Limited to 10 ticks per candle, 1 API key maximum
• Pro tier: Unlimited ticks per candle, up to 3 API keys
• API keys are for personal use only and must not be shared publicly
• We reserve the right to revoke API access for abuse or violations
• WebSocket connections stream real-time generated data only during active scenarios

6. Data and Privacy

6.1 Data We Collect

• Account information (username, email, hashed password)
• Saved scenario configurations and parameters
• Trading strategy configurations (balance, leverage, commission settings)
• Bot API usage statistics and connection logs
• Session and authentication data

6.2 How We Use Your Data

Your data is used to:

• Provide Platform functionality and save your scenarios
• Improve user experience and Platform features
• Maintain security and prevent fraud
• Monitor API usage and enforce rate limits
• Comply with legal obligations

6.3 Data Storage

• Scenarios can be saved on our servers (requires authentication)
• Unsaved scenarios exist only in browser memory during active sessions
• We implement industry-standard security measures

6.4 Data Retention

• Active accounts: Data retained while account is active
• Inactive accounts: May be deleted after 12 months of inactivity
• Deleted accounts: Data permanently removed within 30 days
• Exported data: Once downloaded, you control retention of CSV/JSON exports

7. Intellectual Property

7.1 Platform Ownership

Queyn, including all code, design, branding, synthetic data generation algorithms, and content, is protected by copyright and other intellectual property laws. No license or right is granted except as explicitly stated in these Terms.

7.2 Your Content

• You retain ownership of scenario configurations, strategy parameters, and exported data
• By using the Platform, you grant us a license to store and process your configurations
• You represent that you have rights to any content you create on the Platform
• We do not claim ownership of your trading strategies, parameters, or exported datasets

7.3 License to Use Platform

We grant you a limited, non-exclusive, non-transferable license to:

• Access and use the Platform for personal, educational purposes
• Create, save, and manage simulation scenarios
• Export generated data in provided formats (CSV, JSON)
• Connect trading bots via Bot API for simulation purposes

8. Disclaimers and Limitations

8.1 "AS IS" Provision

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or realism of synthetic data
• Uninterrupted or error-free service
• Predictive value for real market conditions

8.2 Synthetic Data Limitations

• All market data is synthetically generated and does not represent real market conditions
• Generated scenarios are designed for educational pattern recognition, not market prediction
• Technical indicators are approximations for learning purposes
• Spread and liquidity simulations are models based on configurable parameters
• Performance in simulated conditions does NOT guarantee real market results
• Synthetic data should supplement, not replace, historical backtesting

8.3 Service Availability

• We do not guarantee uninterrupted or error-free service
• Maintenance, updates, or technical issues may cause downtime
• We reserve the right to modify or discontinue features with reasonable notice
• WebSocket connections may experience interruptions or disconnections

Methodology Documentation. The statistical properties and known limitations of the synthetic data are publicly documented in the Queyn methodology report, available at doi.org/10.5281/zenodo.21451431. By using the Platform you acknowledge these documented limitations, including that synthetic data does not replicate or predict real market conditions.

9. Limitation of Liability

9.1 Maximum Liability

To the fullest extent permitted by law:

• Our total liability shall not exceed the amount you paid for subscription fees in the past 12 months
• For free accounts, liability is limited to €100 EUR
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not liable for losses from reliance on synthetic data in real trading

Note: Some jurisdictions do not allow limitation of liability. In such cases, our liability is limited to the maximum extent permitted by law.

10. Subscription and Payment

10.1 Free Tier

• Limited features as specified on the Platform
• Subject to usage restrictions (10 ticks per candle, 1 API key)
• May be discontinued or modified at any time with notice

10.2 Pro Tier

• Pricing and features as displayed at time of purchase
• Billed monthly or annually as selected
• Automatic renewal unless cancelled
• Unlimited tick frequency and up to 3 API keys
• No refunds for partial billing periods

10.3 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for unused time within a billing period
• Access to Pro features continues until billing period ends

10.4 Price Changes

We reserve the right to change pricing with 30 days' advance notice. Existing subscribers maintain current pricing until their next renewal period.

11. Termination

11.1 By You

You may terminate your account at any time through account settings or by contacting support. Upon termination, all saved scenarios and configurations will be scheduled for deletion.

11.2 By Us

We reserve the right to suspend or terminate accounts for:

• Violation of these Terms
• Fraudulent activity, abuse, or unauthorized API usage
• Non-payment of subscription fees
• Legal or regulatory requirements
• Extended inactivity (12+ months)

11.3 Effect of Termination

Upon termination:

• Your access to the Platform ceases immediately
• All API keys are revoked and connections terminated
• Saved scenarios and configurations may be deleted after 30 days
• Subscription fees are non-refundable
• You may export your saved scenarios before termination
• Relevant provisions of these Terms survive termination

12. Changes to Terms

• We may update these Terms at any time
• Material changes will be notified via email or Platform notification
• Continued use after changes constitutes acceptance
• The "Last Updated" date reflects the most recent changes
• We recommend reviewing these Terms periodically

13. Third-Party Services

13.1 Google OAuth

• Optional authentication method for convenience
• Subject to Google's Terms of Service and Privacy Policy
• We are not responsible for Google service issues or data handling

13.2 External Links

• The Platform may contain links to third-party resources
• We are not responsible for external content or services
• Third-party sites have their own terms and privacy policies

14. Hold Harmless Agreement

You agree to hold harmless ARVO P.C., its operators, and affiliates from any claims, losses, damages, liabilities, or expenses arising from:

• Your use of the Platform and reliance on synthetic data
• Violation of these Terms
• Infringement of any rights of another party
• Your content, configurations, or activities on the Platform
• Real trading decisions based on Platform simulations
• Misuse of Bot API or unauthorized sharing of API keys

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Greece, without regard to conflict of law provisions.

15.2 Informal Resolution

Before pursuing any legal action, please contact us at info@queyn.com to attempt informal resolution. Many disputes can be resolved quickly through direct communication.

15.3 Arbitration

If informal resolution is unsuccessful, any legal disputes arising from these Terms or your use of the Platform shall be resolved exclusively in the courts of Greece. Both parties consent to the jurisdiction and venue of Greek courts.

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and ARVO P.C. regarding Platform use and supersede all prior agreements.

16.2 Severability

If any provision is found unenforceable, remaining provisions continue in full effect.

16.3 No Waiver

Failure to enforce any right does not constitute a waiver of that right.

16.4 Assignment

You may not assign these Terms without our consent. We may assign our rights without restriction.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond reasonable control (natural disasters, war, network failures, server outages, etc.).
